Drunk Driving Cases

Highway 71 runs straight through Peculiar, bringing constant traffic enforcement and regular DUI checkpoints. Add I-49 proximity and active Peculiar Police Department patrols, and you have frequent DUI arrests. If you’ve been charged, you already understand the severity: license suspension, criminal prosecution in Cass County Circuit Court, massive fines, possible jail time, and insurance rate increases.

Here’s what you might not know: many DUI cases have significant weaknesses. Traffic stops require reasonable suspicion—without it, all evidence gets suppressed. Field sobriety tests rely on subjective officer interpretation and are notoriously unreliable. Breathalyzer machines need regular calibration and maintenance; without proper records, results become inadmissible.

Our criminal lawyers challenge every aspect of DUI prosecutions. We’ve successfully defended hundreds of DUI cases by finding procedural errors, constitutional violations, and weak evidence. Time is critical—you have 15 days from arrest to request a license hearing. Call 816-287-3787 today.

Misdemeanor Offenses

Shoplifting. Simple assault. Possession charges. Disorderly conduct. These cases might not seem serious compared to felonies, but they create the same permanent criminal records. Every employer sees them. Every landlord sees them. Every licensing board sees them.

The good news? Many misdemeanor prosecutions rely on weak evidence: unreliable witnesses, illegal searches, procedural mistakes by police, or situations where context completely changes the story. First-time offenders often qualify for diversion programs—complete simple conditions and charges disappear entirely.

We fight for the best possible outcome in every case. Sometimes that means taking cases to trial. Sometimes it means negotiating favorable plea agreements. Each situation requires a customized defense strategy based on specific facts.

Assault Allegations

Being accused of assault creates immediate problems. You’re facing criminal prosecution, possible jail time, and permanent records affecting employment and reputation. Cass County prosecutors take these cases seriously, seeking maximum penalties even for basic assault charges.

But accusations aren’t convictions. Self-defense is a legitimate legal defense in Missouri. So is defense of others. Many assault cases involve mutual combat where both parties share responsibility, yet only one person faces charges. Sometimes alleged victims exaggerate or lie outright.

Our defense attorneys investigate thoroughly—interviewing witnesses, obtaining surveillance footage, and challenging prosecution narratives. We’ve successfully defended numerous assault cases throughout Cass County.

Domestic Violence

Domestic violence arrests follow predictable patterns: police respond to a call, assess the situation quickly, and arrest someone based on mandatory policies. Now you’re facing criminal charges, protective orders preventing you from returning home, and bond conditions that disrupt your entire life—even if the alleged victim wants charges dropped.

These prosecutions are defensible. Physical evidence is often minimal. Witness testimony conflicts. Many situations involve mutual aggression or false allegations during custody disputes. Our legal team challenges weak evidence and unreliable testimony, working toward dismissals or favorable resolutions that avoid criminal convictions.

Outstanding Warrants

Warrants don’t disappear over time. Whether issued for missed court dates, unpaid tickets, or failure to appear, they remain active until resolved. They show up on background checks. They lead to arrest during routine traffic stops. They create constant worry.

We resolve warrants efficiently and discreetly. Our lawyers verify warrant details, negotiate with prosecutors about underlying charges, and schedule voluntary court appearances that allow resolution without public arrest or jail time. Call 816-287-3787 for confidential warrant assistance.

Understanding the Process

If arrested by Peculiar Police Department, you’ll be transported to the police station (104 N. Cantrell Avenue) for booking or directly to Cass County Detention Center in Harrisonville. Processing includes fingerprinting, photographing, background checks, and personal property inventory. Most first-time misdemeanor and DUI defendants are released on bond within 8-24 hours.

For DUI arrests, Missouri law provides 15 days to request an administrative hearing challenging license suspension. This hearing is separate from criminal court. Missing the 15-day deadline means automatic suspension regardless of criminal case outcome. Contact a defense attorney immediately to preserve this critical right.

Frequently Asked Questions

Q: Should I talk to police without a lawyer present In Peculiar Missouri?
A: No. Exercise your right to remain silent. Police can and will use anything you say against you, even if you think you’re explaining your innocence. Politely decline to answer questions and request an attorney immediately.

Q: What if I can’t afford bail in Peculiar Missouri ?
A: You have several options: request a bond reduction hearing (we can help), use a bail bondsman (typically 10% of total bond), or ask for release on your own recognizance. We represent clients at bond hearings throughout Cass County.

Q: Will I lose my job if I’m convicted?
A: Possibly. Many employers have policies against employing people with criminal records, particularly for certain positions. Even if you keep your current job, future employment opportunities become limited. This is why fighting charges is critical.

Q: Can I get my case dismissed in Peculiar?
A: Possibly. Common dismissal grounds include insufficient evidence, illegal searches or seizures, violated constitutional rights, witness unavailability, and prosecutor’s discretion. We’ve obtained hundreds of dismissals for clients throughout Cass County.

Q: What’s the difference between a DUI and DWI in Missouri?
A: They’re the same offense. Missouri Revised Statutes use “DWI” (Driving While Intoxicated) as the official term, but people commonly say “DUI” (Driving Under the Influence). Both refer to operating a vehicle while impaired.

Q: How long will my case take?
A: Municipal court cases typically resolve in 30-45 days. Cass County Circuit Court cases take 60-90 days for misdemeanors, longer for complex cases. Timeline depends on court scheduling, discovery, negotiations, and whether cases go to trial.

Q: What happens at arraignment in Missouri?
A: Arraignment is your first court appearance where charges are formally read and you enter a plea (guilty, not guilty, or no contest). If you’ve hired us, we often handle arraignments without requiring your attendance for misdemeanor cases.
